Agreement to these Terms
These Terms and Conditions (“Terms”) govern your use of the website at https://forgivenkingdom.com, the Forgiven Kingdom mobile application, and related online features that link to these Terms (together, the “Services”). The Services are operated by Forgiven Kingdom (“Forgiven Kingdom,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
These Terms govern the online Services. Participation in Project 58, other housing programs, employment, volunteering, events, or other activities may be governed by separate applications, agreements, policies, and applicable law. If a separate document conflicts with these Terms on a program-specific matter, the separate document controls for that matter. Nothing in these Terms limits rights or protections that cannot lawfully be waived. Access to housing or support services is not conditioned on religious participation.

We may revise these Terms. We will post the revised Terms with a new “Last updated” date and provide additional notice when required by law or when a change materially affects your use of the Services. Changes take effect on the stated effective date or, if no date is stated, when posted. Continued use after the effective date means you accept the revised Terms.
The general online Services are intended for people age 13 or older. If you are under the age of majority where you live, you must have permission from a parent or legal guardian to use the Services, and that person should review these Terms with you. Eligibility for particular programs is determined separately and may have different age requirements.

1. Our Services
The Services provide information about Forgiven Kingdom, its programs, events, resources, and opportunities to connect with us. Information on the Services is general information and does not replace a participant’s individualized plan, a program agreement, professional advice, or emergency assistance. If you need immediate emergency help, call 911 or the appropriate local emergency service.
People accessing the Services outside the United States are responsible for complying with laws that apply to them. We do not represent that every feature is available or appropriate in every location.
2. Intellectual Property Rights
We or our licensors own the website and app design, software, text, graphics, photographs, videos, logos, and other material we provide through the Services (“Our Content”), except material owned by users or third parties. Our Content is protected by applicable intellectual property laws.
We grant you a limited, personal, nonexclusive, nontransferable, revocable permission to access and use the Services and to download or print portions of Our Content for your personal, noncommercial use or legitimate internal organizational use. You may not sell, republish, distribute, modify, or exploit Our Content for a commercial purpose without our prior written consent, except as permitted by law. No rights in our names, marks, or logos are granted by these Terms. Requests for permission may be sent to chad@forgivenkingdom.com.
Feedback or suggestions that you voluntarily send us about the Services may be used by us without payment or attribution. This feedback provision does not transfer ownership of your private records, case information, or other personal information.
3. User Representations
By using the Services, you represent that information you provide is accurate to the best of your knowledge, you are at least 13 years old, you have any required parent or guardian permission, and your use complies with applicable law and these Terms. If you use the Services for an organization, you represent that you are authorized to act for it.
4. User Registration
Some features may require an account. Keep your login credentials secure and notify us promptly if you suspect unauthorized access. You are responsible for activity through your account to the extent permitted by law. We may require you to change a username that impersonates someone else or violates these Terms. We may suspend access when reasonably necessary to protect users or the Services.
5. Programs and Resources
Descriptions, schedules, eligibility information, and availability of programs or resources may change. A submission through the Services does not guarantee admission, placement, employment, assistance, or a particular service. Program staff will explain applicable requirements through the relevant intake or enrollment process. Separate program policies and agreements govern program participation.
6. Prohibited Activities
You agree not to:
use the Services unlawfully or infringe another person’s rights;
harass, threaten, exploit, impersonate, or deceive another person;
post unlawful, abusive, discriminatory, sexually exploitative, or otherwise harmful material;
disclose another person’s confidential or sensitive information without authority, including participant records or information about a minor;
gain unauthorized access to an account, system, or data; bypass security controls; or interfere with the Services;
transmit malicious code, spam, or unauthorized advertising;
use bots, scrapers, or automated tools to collect data or burden the Services without our written permission, except for ordinary search engine indexing;
copy, reverse engineer, or misuse our software except where applicable law permits; or
use information obtained through the Services to harm another person or to conduct unauthorized commercial activity.
7. User Contributions
The Services may allow you to submit comments, reviews, photos, messages, or other material (“Contributions”). You remain responsible for your Contributions and must have the rights and permissions needed to submit them. Do not post confidential program records, medical information, identifying information about another participant, or images of another person without appropriate permission. A private message, intake form, service request, or other information submitted for a program purpose is not a public Contribution merely because it is sent through the Services.
We may remove, restrict, or moderate Contributions that violate these Terms or may harm users or the Services. We are not required to monitor every Contribution. Views expressed by users are their own.
8. License for User Contributions
You retain ownership of your Contributions. For Contributions you choose to make available through a public or community feature, you grant us a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and distribute them as reasonably necessary to operate and promote that feature, subject to your privacy settings and applicable law. This license ends when your Contribution is removed, except for copies already shared by others, routine backups, or retention required by law. We will not use a participant’s private case information or likeness for advertising under this license. Any separate promotional use requiring a release will require separate permission.
For material you send privately, you grant us only the rights reasonably needed to receive, review, store, and respond to it and to provide the requested Services, consistent with our Privacy Policy and applicable law.
9. Reviews
If a review feature is available, reviews must reflect your honest, firsthand experience. Do not post false statements, threats, confidential information, or content that infringes another person’s rights. We may moderate or remove reviews under these Terms. Reviews express the reviewer’s views, not necessarily ours.
10. Mobile Application License
If you use the Forgiven Kingdom app, we grant you a limited, revocable, nonexclusive, nontransferable license to install and use it on a device you own or control, subject to these Terms and the applicable app store’s rules. You may not copy, modify, distribute, or reverse engineer the app except where law permits.
If you download the app through Apple’s App Store or Google Play, the applicable store is not responsible for operating or supporting the app. These Terms are between you and Forgiven Kingdom, subject to any rights an app store has under its own terms and applicable law.
11. Third Party Websites and Content
The Services may link to websites, applications, or content operated by others. We do not control their content, availability, or privacy practices. Review their terms and privacy policies before using them. A link does not necessarily mean we endorse the third party.
12. Advertising
If advertising or sponsored content appears on the Services, we may identify it as such where appropriate. An advertisement does not by itself constitute our endorsement. Third party advertisers are responsible for their own offers and claims.
13. Services Management
We may manage the Services to protect users, security, and operations. This may include reviewing reported content, limiting access, removing content, responding to lawful requests, and taking steps against misuse. We will exercise these rights consistently with applicable law and our obligations concerning confidential information.
14. Privacy
Our Privacy Policy explains how we collect, use, and share personal information through the Services: https://www.forgivenkingdom.com/privacy-policy. Please read it. Additional privacy notices or authorizations may apply to particular programs or information. These Terms do not replace those notices, authorizations, or legal requirements. We do not knowingly collect personal information through the Services from children under 13 without any consent required by law. Contact us if you believe a child under 13 has provided information to us.
15. Copyright Notices
If you believe content on the Services infringes your copyright, send a written notice to the copyright contact below identifying the work, the material and where it appears, your contact information, a good faith statement that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are authorized to act, and your physical or electronic signature. If your material was removed by mistake, you may send a counter notice identifying the removed material and its former location, your contact information and signature, a statement under penalty of perjury that you believe removal was a mistake, your consent to the jurisdiction required by 17 U.S.C. § 512(g), and your agreement to accept service from the complaining party or its agent. We will process notices and counter notices as applicable law requires.

16. Term and Termination
These Terms apply while you use the Services. You may stop using them at any time. We may suspend or terminate an online account or access if you violate these Terms, create a security risk, or misuse the Services, subject to applicable law. Account action under these Terms does not itself decide anyone’s housing placement, services, benefits, or other program rights, which are addressed through the applicable program procedures and law. Provisions that by their nature should survive termination will continue to apply.
17. Changes and Interruptions
We may update, suspend, or discontinue a feature of the Services. Availability may be interrupted by maintenance, technical problems, or circumstances beyond our control. We will provide notice when required by law. We do not guarantee uninterrupted access, but this section does not limit rights that cannot lawfully be waived.
18. Governing Law
California law governs these Terms, without regard to conflict of law rules, except where federal law or another mandatory law applies.
19. Dispute Resolution
Before filing a formal claim concerning the online Services, you and Forgiven Kingdom agree to try to resolve the matter informally by sending a written description to the contact address in Section 29 and allowing 30 days for a response. This step does not prevent either party from seeking urgent relief or exercising a right that cannot be delayed by law.
Except for claims that applicable law does not permit to be arbitrated, either party may require an individual dispute arising from these Terms or use of the online Services to be resolved by binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The arbitrator may award any relief available under applicable law. Fees will be allocated under those rules and applicable law. The hearing may take place by video, telephone, documents, or in person as permitted by the rules, with an in-person hearing in Los Angeles County unless the rules or applicable law require another location. Either party may bring an eligible claim in small claims court. Either party may seek a court order to protect intellectual property or prevent unauthorized access or disclosure. No person is required to waive a nonwaivable right or remedy. Claims related to housing placement, employment, or other separately governed programs are outside this online Services arbitration provision unless a separate valid agreement expressly provides otherwise.
To the extent permitted by law, claims covered by arbitration will proceed on an individual basis, and neither party will seek class or representative arbitration. If a court finds this class or representative restriction unenforceable for a particular claim, that claim will proceed in court rather than arbitration to the extent required by law. If a dispute proceeds in court, the parties consent to state or federal courts with jurisdiction in Los Angeles County, California, unless applicable law requires another forum. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration section where applicable.
20. Corrections
We may correct errors or update information on the Services, including program descriptions and schedules. If a correction materially affects a specific agreement or obligation, that agreement and applicable law control.
21. Disclaimer
The online Services and their general informational content are provided “as is” and “as available,” to the extent permitted by law. We do not guarantee that the online Services will always be accurate, secure, or uninterrupted. Nothing in this section disclaims obligations that we owe under applicable law, a separate program agreement, or a professional duty.
22. Limitation of Liability
To the fullest extent permitted by law, Forgiven Kingdom and its personnel are not liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of the online Services. This limit does not apply where prohibited by law, including to liability that cannot lawfully be excluded. It does not limit obligations under a separate program agreement or claims arising from the provision of housing or direct care services. Any remaining liability arising solely under these Terms will be determined under applicable law.
23. Indemnification
To the extent permitted by law, if your unlawful conduct or material breach of these Terms causes a third party to bring a claim against us, you agree to reimburse reasonable losses and expenses directly resulting from that claim. This provision does not require you to indemnify us for our own negligence, misconduct, or violation of law, and it does not apply to claims concerning the provision of housing or direct care services.
24. User Data
We maintain data as described in our Privacy Policy and applicable program notices. Please keep copies of information you need for your own records. Contact us if you need help accessing information, subject to verification, retention rules, and applicable law. We cannot promise that all online data will always be available, but we will not use these Terms to waive duties imposed by privacy or recordkeeping law.
25. Electronic Communications and Signatures
By using the Services or contacting us electronically, you agree that we may communicate with you electronically about the Services, subject to applicable law and any communication preferences you provide. Where permitted by law, electronic notices, records, and signatures may satisfy writing and signature requirements. If a separate process requires a particular form of notice or consent, that process controls.
26. SMS Text Messaging
If you separately opt in to receive text messages from Forgiven Kingdom, we may send messages about appointments, service updates, account notices, events, or marketing, according to the consent you provided. Message frequency varies. Message and data rates may apply. Consent to marketing texts is not a condition of receiving housing or other services. Reply STOP to opt out of a messaging program or HELP for assistance. You may also contact chad@forgivenkingdom.com or 866-308-0073. We may send a confirmation of your opt-out and, where permitted, essential nonmarketing communications by another lawful method. Carriers are not responsible for delayed or undelivered messages. See our Privacy Policy for information about data practices.
27. California Users and Residents
If a complaint about the Services is not resolved with us, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or at (800) 952-5210 or (916) 445-1254.
28. Miscellaneous
These Terms, together with policies expressly incorporated into them, form the agreement concerning the online Services. Separate program documents remain effective for their own subject matter. If a provision is unenforceable, the remaining provisions remain effective to the extent possible. Our failure to enforce a provision once does not waive it. We may assign these Terms as permitted by law. Neither party is responsible for delay caused by events beyond its reasonable control, except for obligations that cannot lawfully be excused. These Terms do not create an employment, agency, joint venture, or partnership relationship with users.
